🌐 Domain Name Registration Agreement

General Registration Agreement, Terms and Conditions of Domain Name Registration and Related Services

IMPORTANT: THIS AGREEMENT HAS A PROVISION FOR ARBITRATION OF DISPUTES BETWEEN THE PARTIES. By using the Services, you agree to all terms and conditions of this Agreement.

Agreement Overview

This Registration Agreement ("Agreement") sets forth the terms and conditions of your use of domain name registration and related services ("Services"). "You" and "your" refer to you and the registrant listed in the WHOIS contact information. "We," "us" and "our" refer to the registrars listed at the bottom of this document. You obtain the Services through your Primary Service Provider (Speedy Group). To determine which registrar your domain name is registered with, perform a WHOIS lookup at hostingspeed.net/account/whois.php.

Your Agreement

By using the Services, you agree to all terms of this Agreement; ICANN Policies at icann.org; any rules, agreements, or policies of any relevant TLD registry; the UDRP and URS; and any rules, policies or agreements of any relevant government. Violation or refusal to comply with any ICANN policy is a violation of this Agreement and may result in immediate termination.

Changes to This Agreement

This Agreement may change over time. Before material changes become binding (other than ICANN policy or law changes), we or your Primary Service Provider will notify you by email. If you no longer agree, your exclusive remedies are to transfer your domain to another registrar or cancel your Services. Continued use indicates consent. Changes bind you 30 days after notice, or immediately for ICANN policy/law changes.

Registrant Rights and Responsibilities

ICANN has developed a document identifying important registrant rights and responsibilities, providing a plain-language summary of terms in the Registrar Accreditation Agreement (RAA) and ICANN Consensus Policies. Please review these important Registrant Rights and Responsibilities at ICANN's website.

Your Account

You must create an account to use the Services. You are solely responsible for maintaining, securing, and keeping strictly confidential all login IDs and passwords, and for all access to and use of your Account. If you contact us alleging that a third party has unauthorized access to your Account or domain names, we may charge you administrative fees, currently set at fifty dollars ($50) per hour, for our time spent in relation to the matter, regardless of whether or not we return control over the Account and/or domain name(s) to you.

Data required for the registration of a domain name varies by top-level domain. The required data for a domain name registration ("Minimum Data") will be presented at the time of registration or renewal and may include up to: Name and postal address of the Registered Name Holder; Registered name; Names of the primary nameserver and secondary nameserver(s) for the Registered Name; Name, postal address, e-mail address, and voice and fax (if available) telephone numbers of the administrative contact for the domain name; Name, postal address, e-mail address, and voice and fax (if available) telephone numbers of the billing contact for the domain name; and Name, postal address, e-mail address, and voice and fax (if available) telephone numbers of the technical contact for the domain name. The Minimum Data will be shared with Enom and may be shared with the relevant authoritative registry services provider for your top-level domain. The identity of the authoritative registry services provider can be found at https://www.iana.org/whois.

To access, view, update, delete or download data associated with your domain name registration, you must be signed into your account. If you make a request to delete your personal data and that data is necessary for the products or services you have purchased, the request will be honored only to the extent it is no longer necessary for any services purchased or required for our legitimate business purposes or legal or contractual record keeping requirements. In some cases, when data is necessary for the provisioning of service, deletion of data may cancel or suspend the services you have purchased. If you have difficulty accessing your data, modifying it, or deleting it, you may request assistance by sending email to [email protected] or using the contact information at https://www.enom.com/terms/privacy.aspx.

Account Contact, Verification and WHOIS

You must provide current, complete and accurate information for your Account and domain WHOIS. Within 7 days of new registration, transfer, or any change, you must update and verify such information. Required data varies by registration but may include registrant, administrative, technical and billing contacts: name, postal address, email, voice telephone, and fax (if available). Not providing requested information or missing WHOIS verification may prevent you from obtaining all Services.

You may provide nameserver information to be assigned to the domain name. If complete nameserver information is not provided, or if you purchase a domain-only service, we may supply such information and direct the domain to a website of our choosing until you elect to provide nameserver information.

Data Sharing

Data required for domain registration varies by TLD. The Minimum Data presented at registration or renewal may include: name and postal address of the Registered Name Holder; registered domain name; names of primary and secondary nameservers; and name, postal address, email address, and voice and fax (if available) telephone numbers of the administrative, billing and technical contacts. Minimum Data will be shared with Enom and may be shared with the relevant authoritative registry services provider. Account Obligations & WHOIS Accuracy

If you provide information about a third party, you warrant that you have provided notice and obtained express written consent. You warrant that all information is accurate and Services are not for Illegal Uses (infringement, malware, botnets, phishing, fraud, counterfeiting, etc.). Inaccurate information, failure to update within 7 days, Illegal Uses, or failure to respond within 15 days to inquiries constitute an incurable material breach. You are responsible for monitoring email sent to your Account address.

Domain Name Registration

We are ICANN-accredited registrars for gTLDs (.com, .net, .org, etc.) and various ccTLDs. Domain registrations are not effective until acknowledged by the registry. We and your Primary Service Provider are not liable for errors or omissions by the registry administrator. Domain name registration is a service, not a property interest. For pre-registration applications, we do not guarantee the domain will be secured, and if two or more applications are received for the same domain, all applicants will be invited to a private auction.

Not Included in the Services

We are not responsible to determine whether the domain name(s) you select, or the use you or others make of them, infringes legal rights of others. It is your responsibility to know whether the domain name(s) you select or use infringe legal rights of others. It is not our responsibility to forward court orders or other communications to you. Our policy is to comply with court orders from courts of competent jurisdiction as well as UDRP and URS Panel decisions.

Use of Free Services

In consideration for providing Free Services (URL forwarding, email forwarding, free parking page, free hosting, etc.), we may display advertising via pop-ups, banners, audio/video streams, or other means, and aggregate usage data via cookies. You will not be entitled to any advertising proceeds. We may discontinue any Free Services at any time with or without prior notice.

Services Termination or Suspension

We and your Primary Service Provider may reject an application or discontinue Services within 30 days of initiation or renewal for any reason. Outside this period, termination or suspension requires cause: (i) prohibited domain names; (ii) Services abuse; (iii) payment irregularities; (iv) allegations of illegal conduct or IP infringement; (v) inaccurate WHOIS; (vi) failure to respond within 15 days; (vii) failure to comply with ICANN/registry policies; (viii) Services involving violation of third-party rights. No fee refund for cause-based termination. For non-cause termination, 30 days notice and pro-rata refund of fees apply.

We and any domain name registry reserve the right to deny, cancel, or transfer any domain name registration, or place any domain name on lock, hold, or similar status, in order to protect the integrity and stability of the registry, comply with ICANN requirements, comply with applicable laws or government requirements, resolve disputes, or for any other reason at our sole discretion.

Fees and Taxes

You agree to pay the applicable fees prior to service effectiveness. If fees change, we will give 30 days notice. All fees are non-refundable even if your domain registration is suspended, cancelled or transferred prior to end of term. In the event of a credit card chargeback, we may suspend all Accounts and all associated services. We may reinstate at our discretion upon receipt of unpaid fees and our then-current reinstatement fee.

Expiration and Renewal of Services

It is your responsibility to maintain reminders regarding domain expiration dates. Renewal notifications are provided on a best-efforts basis only — approximately 60 and 30 days before expiry. On most cases, after a domain expires for 29 days it may be reserved for a redemption period of approximately 30 days (NOT GUARANTEED). Redemption fees: .hk domain HK$200; other domains HK$2,500. We cannot guarantee any expired domain is renewable. Refunds are available if renewal is not successful. We encourage customers to renew at least 14 days before expiration.

Expiration of a Domain Name Registration

Upon expiration, we may direct the domain to name-servers and IP addresses of our choosing, including parking pages displaying advertisements. Several critical stages occur after expiration, including reactivation, redemption, or possibly auction. These stages may not apply to some ccTLDs, which can go into redemption before their expiration date and not offer grace periods.

Reactivation Period: For approximately 30 days after expiry, we may provide a renewal process. We may, but are not obligated to, offer this process. The reactivation period may involve additional fees. We may make expired domain services available to third parties or proceed to auction. After the reactivation period, we may discontinue the domain at any time.

Redemption Period: After a domain has passed through any applicable expiration grace period, it may go into a non-guaranteed redemption period which typically lasts 30–45 days. The system may also move the domain to auction in this period. The domain cannot be modified or transferred in this state and will continue to point to an expired page. The account holder or registrant must recover the domain to bring it back online. There is an additional fee to restore domains from redemption as well as the renewal fee.

If the domain is not recovered from redemption, the registry will eventually delete it. Once the domain enters the pendingDelete status at the registry, the registry will delete the domain within five (5) days. After the registry deletes the domain, it will be available on a first-come-first-served basis.

Transfers

Transfer of domain services shall be governed by ICANN's transfer policy. To transfer, log into your Account to obtain the EPP AuthCode. Transfers are not permitted within 60 days of initial registration or a previous transfer, if there is a registrant identity dispute, if you are bankrupt, or if fees are unpaid. Transfers typically take 5 business days. YOU ASSUME ALL RISK FOR FAILURE OF A TRANSFER WHETHER OR NOT THE TRANSFER PROCESS IS INITIATED CLOSE TO THE END OF A REGISTRATION TERM. You explicitly authorize us to act as your Designated Agent to approve each Change of Registrant on your behalf.

Ownership of Information and Data

We own all database, compilation, collective and similar rights, title and interests worldwide in our domain name database and all information and derivative works generated therefrom. This includes: (a) original creation date; (b) expiration date; (c) registrant and contact information; (d) WHOIS remarks; (e) any other information generated in connection with Services. We do not have any ownership interest in your specific personal registration information outside of our domain name database rights.

Agents and Licenses

If you register a domain name for or on behalf of someone else, you represent that you have the authority to bind that person as a principal to all terms herein. If you license the use of a domain name to a third party, you remain the holder of record, responsible for all obligations under this Agreement including payment, providing and updating your full contact information, and ensuring non-infringement of third-party rights.

Limitation of Liability

WE WILL NOT BE LIABLE FOR ANY: (a) SUSPENSION OR LOSS OF THE SERVICES; (b) USE OF THE SERVICES; (c) INTERRUPTION OF SERVICES OR INTERRUPTION OF YOUR BUSINESS; (d) ACCESS DELAYS OR ACCESS INTERRUPTIONS TO OUR WEBSITE(S) OR SERVICES; (e) LOSS OR LIABILITY RESULTING FROM ACTS OR EVENTS BEYOND OUR CONTROL; (f) DATA NON-DELIVERY, MIS-DELIVERY, CORRUPTION, DESTRUCTION OR OTHER MODIFICATION; (g) THE PROCESSING OF AN APPLICATION FOR A DOMAIN NAME REGISTRATION; (h) LOSS OR LIABILITY RESULTING FROM UNAUTHORIZED USE OR MISUSE OF YOUR ACCOUNT IDENTIFIER OR PASSWORD; OR (i) APPLICATION OF ANY DISPUTE POLICY.

NEITHER WE NOR YOUR PRIMARY SERVICE PROVIDER WILL BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR OR YOUR PRIMARY SERVICE PROVIDER'S MAXIMUM AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU FOR SERVICES, BUT IN NO EVENT GREATER THAN FOUR HUNDRED HONG KONG DOLLARS (HK$400.00).

Indemnity

You hereby release and agree to indemnify, defend, and hold us, ICANN, the registry operators, and your Primary Service Provider harmless from and against any and all liabilities, claims, damages, costs and expenses, including reasonable attorneys' fees and court costs, for third-party claims relating to or arising under this Agreement, the Services provided hereunder, or your use of the Services, including infringement or alleged infringement of any intellectual property or other right of any person, or violation of our or ICANN's operating rules or policies.

Representations and Warranties

YOU REPRESENT AND WARRANT THAT NEITHER THE REGISTRATION OF A DOMAIN NAME NOR THE MANNER IN WHICH IT IS USED INFRINGES THE LEGAL RIGHTS OF A THIRD PARTY OR WILL SUBJECT US TO A LEGAL CLAIM. THE SERVICES ARE INTENDED FOR PERSONS AT LEAST EIGHTEEN (18) YEARS OLD. ALL SERVICES ARE PROVIDED "AS IS" AND WITH ALL FAULTS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE MAKE NO WARRANTIES THAT REGISTRATION OR USE OF A DOMAIN NAME WILL IMMUNIZE YOU FROM CHALLENGES TO YOUR REGISTRATION, OR FROM SUSPENSION, CANCELLATION OR TRANSFER.

Dispute Resolution Policy

You are bound by all ICANN consensus policies and relevant registry policies, including the UDRP and URS. The UDRP and URS may be changed by ICANN at any time. If your domain name is challenged by a third party, you will be subject to the UDRP and URS provisions in effect at that time. In the event of a domain name dispute, you will indemnify and hold us harmless pursuant to the terms of the UDRP and URS. If you or your domain name are involved in litigation, we may deposit control of the domain name record into the registry of a court of competent jurisdiction.

Governing Law and Arbitration

Except as otherwise set forth in the UDRP or URS, this Agreement shall be governed by the laws of the United States and the State of Washington. Any dispute shall be determined by arbitration in King County, Washington, before one arbitrator, administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A CLASS MEMBER IN ANY FORM OF A CLASS PROCEEDING.

WHOIS Sharing of WHOIS Information

We will make available domain name registration information to: ICANN, any ICANN-authorized escrow service, the registry administrator(s), and other third parties as ICANN and applicable laws may require or permit (including through WHOIS lookup systems), during or after the term of your domain name registration services. You irrevocably waive any and all claims arising from such disclosure or use of such information.

ICANN may establish or modify guidelines, limits and/or requirements regarding the amount, type, and manner of information we may make available to the public or to private entities. For ICANN's guidelines on WHOIS, please refer to: WMRP, WDRP and www.icann.org.
